Terms And Conditions
If you have never visited the American Marketing, Life of the Rich and
Famous Villa’s before, it will be important to familiarize yourself with the
following information to better understand the process involved in reserving
villa’s and what you can expect from our contract information and payment
process. Even if you have been a guest of ours in the past, you should be aware
of some recent policy changes.
All our villas are located on the mountainside in the Las Brisas area and all afford a privileged view to the bay and/or open ocean.
There is a small, private beach as well as a large public beach. It is your choice, and your driver will be happy to take you.
American Marketing is proud to have earned a FIVE (5) STAR Security Clearance from XEROX Corporation. Security Gates with 24 hour guards are at the entrances to the 6 subdivisions that contain our villas: Marina Las Brisas, GuitarronLas Brisas, Lower Las Brisas, Upper Residential Las Brisas, BrisasMarques, Lomas Marquesa.
Each of our villas are individually and privately owned and hosted by American Marketing (Chicago). Each villa is uniquely decorated and comprised of much more than just the minimum standard of quality and comfort found in a hotel or deluxe resort. Every bedroom is serviced by its own bath.
All of our villas enjoy a private pool, and are serviced by at least one Houseman and/or Waiter, Cook and Chambermaid. To service more than 10 individuals in one villa, additional staff is provided.
Events top
In order to make your event a successful occasion, please make sure that you let us know of your plans from the onset. The use of a villa for a scheduled event, requires previous authorization and extensive planning with our Reservations and Customer Service Departments.
Our villas are private properties. Commercial photographic sessions or photography or filming of any kind may not be published and/or reproduced without the written consent of the property owner and/or administrator.
Addresses: top
Villa Addresses and Phone Numbers will be distributed to our guests once full payment
is made and arrival is eminent. Please be sure that relatives, friends and
office staff know in which villa you and your guests will be staying.
Deposits and Payments: top
All deposits and payments are considered non-refundable, but can be used for future rentals as stated in the Cancellation section, below. The payment schedule is as follows:
25% of total land costs are due upon final authorization of the itinerary.
50% of land costs are due 120 days prior to departure.
All other costs, including land, air and
program activity budgets must be paid in full 90 days prior to departure, unless
otherwise specified and agreed to in writing by the client and American
Marketing.
Force Majeure: top
American Marketing shall not be liable or pay
any compensation or provide refunds or credits when travel arrangements need to
be cancelled or changed in any way due to force majeure, unusual and
unforeseeable circumstances beyond the control of American Marketing or the
client, the consequences of which could not have been avoided even if all due
care had been exercised. This includes, but is not limited to terrorist
activities, war, riots, sudden illness, accident, natural disaster, avalanche,
fire, weather conditions, hurricanes or any other unforeseen circumstances.
Cancellations: top
At 90 days prior to arrival, all reservations are considered final. In the case of
a cancellation within 90 days and prior to 60 days before arrival, client will be credited for a future rental within a 12 month period at the same or equal villas, however a 10% change fee will be charged. Client agrees to a minimum of 90% of the originally contracted room nights and group size. Any cancellations or changes within 60 days and prior to 30 days of arrival, client will be credited for a future rental within a 12 month period at the same or equal villas, however a 20% change fee will be charged.
There are NO
GUARANTEES FOR REFUNDS and NO CREDITS for cancellations made within 30 days of the scheduled arrival date. All cancellations and changes must be in writing.
Cause for Eviction: top
Illegal and illicit behavior is not tolerated in our villas. This clearly includes the
use of recreational drugs, prostitution and extensive intentional damage to the
property. The primary authorized lessee must be at least 25 years of age. This will be strictly
enforced. Remember, these are private homes and should be treated as your own.
Exceeding the number of confirmed occupants stated in the contract is also
cause for eviction, which may occur beyond our control and without expectation of a refund. Please avoid this security breach by
reporting all individuals that are staying in the property ahead of time.
Check-In / Check-Out: top
Check-In Time is generally
Children: top
Villas are ideal for vacationing families traveling with small children.
Unfortunately, due to the steep hillsides in Las Brisas,
some of the villas are not Child Friendly. Please let your American Marketing
representative know if you are traveling with children and their ages; in order that we may select an ideal villa for your group. Keep in mind, each villa is someone's private home, and house rules are final. An orientation of do's, don't's and off-limits is discussed with the parents of children and will be diplomatically enforced.
Construction: top
In the unlikely event that our office has not been
notified ahead of time of an eminent construction nearby your villa, please be
understanding. We will attempt to contact the contractor concerning noise and
start times. We will attempt to notify you ahead of time whenever it is
possible when we have detected there will be loud noises and interference from
a construction site and may attempt to move you. In many cases we are not
notified ahead of time of a pending construction nearby,please accept our apologies in advance if this should occur.
Damage Responsibility: top
The client
will be responsible for and will assume liability for any loss or damage to
the villa, vehicles or property, during their occupancy. American Marketing will not pursue "charging" individual guests in the
villa; this will be the responsibility of the client responsible for the
reservation. Any breakage, theft and/or villa damage during your stay will
be reported by the staff to American Marketing immediately, however damages or losses may be detected after departure. Should this occur, our Customer
Service Department will show you the damage that has been reported and the
replacement cost will be billed to your corporate account.
Upon submission of a formatted guest
list by the host of your trip, the guests named thereon hereby agree to these terms and conditions and acknowledge and hold harmless, American Marketing and all their employees, contracted tour operators, suppliers and vendors associated with the arrangement and delivery of your travel program against any claims for late arrivals, missed flights, lost luggage, injury, accident, death or acts of God. Optional trip interruption, accident-injury and cancellation insurance is available from many sources, however it is not provided under these terms. American Marketing accepts no responsibility for loss, late delivery or non-performance by any supplier, airline or transportation company which may be beyond our control.
Food and Beverages: top
American Marketing handles all the menus and bar provisions during your stay. Menus are prearranged prior to arrival. If there are any special requests or needs, please inform your American Marketing representative and arrangements shall be made to modify provisions. If additional charges apply, it will require approval prior to purchase of supplies. All approved upgrades to the pre-arranged provisions list shall be billed to your corporate account..
Forgotten Items: top
American Marketing will not be responsible for any items left in the villa. A
$25.00 USD service charge and COD costs are required if you request American
Marketing to retrieve them and mail them to you. Some items cannot be sent
due to customs restrictions and, therefore, should be retrieved within 90 days.
If you are done with a novel that you have brought along or if you have any items that you decide to leave in the villa purposely, please advise us, so we do not mistake the item(s) for lost belongings.
Guests: top
If you expect to have guests visit the villa, who are
not on the reservation list, this must be made known to American Marketing and
authorization is required. Additional expenses may be incurred. This does
NOT refer to special events, which are generally catered and require previous
written authorization. The villa
owner reserves the right to remove any visitor
from his property, if they are not registered, or if American Marketing
is not notified of their intended arrival.
American Marketing reserves the right to cancel any event which is not duly authorized; and/or if the subdivision administration should receive any complaints regarding parking, noise or uncontrolled behavior. Refunds should not be expected when violating this policy.
Additional Items for Rent: top
If an additional item is requested, whether it be a
crib, a Cellphone, Satellite Dish, Projectors, large Screen TV or a carseat , these items are available for rent at an
additional cost. If you require Internet connection, our Systems Engineer will be happy
to connect you for an additional fee. Any subsequent services
regarding installation at the villa will require a charge of $100US
Sending Packages Ahead:
If you MUST send a package ahead of arrival, it would be more secure to have
the package delivered to us and have our Customer Service Department have it ready at the villa on arrival day. WE DO NOT RECOMMEND SENDING PACKAGES AHEAD.
(Customs procedures are extremely complicated. Your items may be held in
Customs and never released if proper procedure is not followed and fees are not
paid.) Please inquire with us as to the proper documentation requirements prior
to sending any packages to
Although most
villas are equipped with a phone and some have second lines, faxes and internet
access, you may want your messages to be sent to the American Marketing office
in case someone cannot reach you at the villa. Phone numbers will be provided
prior to your departure for all emergency contacts.
Money Exchange: top
American Marketing will be glad to assist you in exchanging money for you when
you arrive or prior to arrival. You will receive a BETTER rate than Banks, the
Airport or any stores in town. In order to register as a client to cash a
personal check in US Dollars, you must provide us with a copy of your passport, your
address and work phone number. We will provide you with a letter that must be
signed to guarantee funds in case of a bounced check. Cash and Traveler's
Checks are also accepted and much advised. Please make sure your bills are not torn or taped and
are in generally good condition, as Mexican retailers, banks and currency exchanges often reject any bills that are in poor condition. Travelers Chequesmust be countersigned. The money you receive in pesos is at the USD buy rate.
If for any reason you need to buy dollars, this would be at the
Occupancy: top
The normal maximum occupancy permits 2 persons per
bedroom (not counting children under 4) and includes nannies or other staff
members. Some villas will permit additional individuals depending on bed
distribution. The maximum number of persons should be reflected in the rental
contract. If your group exceeds the maximum occupancy as stated, this is
treated as a material breach of your contract agreement and is grounds for
immediate eviction from the property. You may be reaccommodatedinto a larger villa at the rate of that property, or you may be charged an
additional fee per person over the maximum staying in the villa. The decision is at the discretion of the property owner.
Staff and Tipping: top
We request that the Staff in the villas be treated
with utmost respect. Please note that the level of service you will receive in
If your guests wish
to offer an additional gratuity for exceptional service, it is most appreciated.
Please take special consideration for late night service, extra trips to town,
or small personal favors performed above the call of duty. Our most sincere,
minimum recommendation is to pool $10 to $20 US per guest per day and ditribute
them based on a formula which American Marketing will provide.
Tips should be distributed only at the end of the stay,
directly to each staff member during the much cherished "good-bye / thank-you"
hour. If for any reason you are unhappy with the service that has been provided,
you should report this immediately to American Marketing. DO NOT WAIT UNTIL THE
END OF YOUR STAY TO REPORT ANY DISSATISFACTION OF ANY SERVICE. Often times a
slight misunderstanding in communication can be rectified
immediately.
Drivers and Vehicles:
top
The American Marketing transportation staff consists of Federally
Licensed Tour Directors, certified by the Mexican Government. Drivers and
vehicles are provided for a period of 10 hours per day. However, from time
to time, late night transportation and services are requested above the standard
time period. Drivers gratuities should be handled seprately, as they are
not included in the program costs. Driver overtime is charged to the
corporate account at $25 per hour. (two-hour minimum)
Pets: top
Pets are not allowed in the villas. This is a firm rule.
Refunds: top
American Marketing recommends the scheduling of an inspection trip for any group exceeding 40 persons. In all cases American Marketing inspects all properties prior to arrival to assure comfort, plant functionality and staff performance. Once you have entered into a contract, you are binding
yourself to a specific property for a specific period of time, during which the property owner refuses any other rentals inquiries. There should be no expectation of
compensation or relocation because you do not like the property or something in
the property is not working to your satisfaction. We will make every attempt to
correct any malfunctions or problems encountered, but no refunds should be
expected. Please see Cancellations for more information on refunds.
Telephones
/ Long Distance Calls: top
All of our villas provide a telephone
for use. Long distance calls may be made directly, but these charges will be
billed directly to your corporate account within 60 days of your departure. The
cost of a long distance call includes a 15% tax. Cellular phones are available
for rent if you prefer to use this with a "debit" card. Calling cards can also
be used from the phones in the villas for your convenience.
